PKU Family is not a medical device, medical service, or telemedicine service.
The App provides voluntary home food-tracking tools and reference information, including
responses from the in-app AI assistant "Phoebe." The App does not diagnose conditions,
prescribe treatment, determine a safe phenylalanine limit, or replace a physician,
dietitian, or other healthcare professional. Any decisions about health, diet, medical foods,
medicines, amino acid formulas, or dosages must be made only together with the user's
treating healthcare professional.
These Terms of Service ("Terms") govern the use of the PKU Family mobile application
(package identifier com.family.pku, the "App"), developed by Ivan Silantev
("we," "Developer"). By installing or using the App, you ("User") agree to these Terms and
the Privacy Policy. If you do not agree, please do not use the
App.
1. Who May Use the App
The App may be used by an adult user (18 years or older) who has created their own
account — either to track their own diet or as a parent managing their children's
profiles;
Children can only access their part of the App through a profile created and managed by
their parent/legal guardian, using an access code — self-registration by a child is neither
possible nor supported;
By creating a child profile, the adult user confirms they are the child's parent or legal
guardian and is responsible for that child's use of the App;
The parent or legal guardian is responsible for reviewing all entries, limits, photos,
recipes, and other data related to the child, and for following the treating healthcare
professional's instructions.
2. Account and Access Code
You are responsible for keeping your account password and any access code issued to a
child confidential, and for all activity that occurs under your account or via that access
code;
Notify us immediately if you suspect unauthorized access to your account;
We may restrict or suspend account access if we suspect fraud, an attempt to brute-force
a child's access code, or any other breach of these Terms.
3. Medical Status, Calculations, and the AI Assistant
The User understands and agrees that PKU Family is intended only for home reference tracking
and is not intended for diagnosis, prevention, treatment, medical monitoring, replacement of
clinical tests, prescribing a diet, or making urgent medical decisions.
The App does not create a physician-patient relationship, does not provide medical,
dietetic, telemedicine, or other regulated healthcare services, and does not issue
individualized treatment instructions;
Daily phenylalanine limits, blood target ranges, medical foods, amino acid formulas,
medicines, and any therapy changes are determined only by the treating healthcare
professional. The App only stores values entered by the user;
All phenylalanine, protein, fat, carbohydrate, and calorie calculations are informational
and approximate. They depend on the accuracy of user-entered data, portion weight, recipe,
manufacturer, product batch, preparation method, and selected reference tables;
The food database, recipes, articles, prompts, product traffic-light labels, and any
norms in the App are not universal medical rules. An individual plan from a physician or
dietitian always prevails;
The "Phoebe" AI assistant generates responses automatically using the Google Gemini model
and may make mistakes, give incomplete or inaccurate answers, or misidentify products,
labels, photos, voice messages, or context;
The User must independently review labels, ingredients, portion weights, phenylalanine
values, saved entries, and the treating healthcare professional's instructions before using
App data for everyday food planning;
The User must not change diet, phenylalanine limits, medical foods, medicines, amino acid
formulas, testing schedules, or any other aspect of PKU management solely on the basis of
App data, calculations, or responses;
For worsening condition, unusual symptoms, high or low test results, pregnancy, pregnancy
planning, or other medically significant circumstances, the User must contact their
healthcare professional or emergency services rather than rely on the App.
4. User-Generated Content
The App allows users to create their own recipes and, when using the relevant feature,
publish them to a shared catalog visible to other users ("user content"). Such content is
not medical advice and may contain errors, even if it has passed a technical or editorial
review.
By publishing a recipe or other content to the shared catalog, you confirm you hold the
rights to it and grant us a non-exclusive, royalty-free license to store and display it to
other App users;
You may not publish content that infringes third-party rights, contains false claims
about a product's safety for a PKU diet, or is abusive, unlawful, or misleading;
We may remove user content that violates these Terms without prior notice;
Publication of a recipe or product in the catalog does not mean that it is suitable for
a specific patient, age, diagnosis, therapy, or assigned phenylalanine limit;
Private (unpublished) recipes and diary entries remain visible only to you and the child
profiles linked to your account.
5. Prohibited Use
Using the App as the sole source for decisions about health, diet, treatment, medical
foods, medicines, dosages, or medical monitoring;
Using the App for emergency medical assistance, diagnosis, prescribing, or changing
treatment;
Presenting App calculations, AI responses, or other App materials to third parties as a
medical opinion, physician order, laboratory result, or guarantee that a product is safe;
Using the App by a medical organization, physician, dietitian, or other professional as a
clinical decision support system without independent review and compliance with applicable
legal requirements;
Knowingly entering false data about products, recipes, ingredients, phenylalanine,
diagnoses, limits, or user age;
Attempting to gain unauthorized access to other users' data, including by
brute-forcing a child's access code;
Using automated tools (bots, scripts) to interact with the App or its infrastructure
outside the normal user interface;
Attempting to disrupt the App, its server infrastructure, or its protective systems
(App Check, Play Integrity);
Using the App in violation of applicable law.
6. Intellectual Property
The App, including its design, source code, logo, the "Phoebe" character, the recipe
database, and text content (excluding user content), belongs to the Developer or is used
lawfully by the Developer. These Terms do not transfer any rights to these assets other than
a personal, non-commercial right to use the App for its intended purpose.
7. Limitation of Liability
The App is provided "as is," without warranties of any kind, express or implied, including
warranties of medical suitability, calculation accuracy, completeness of the food database,
uninterrupted operation, meeting user expectations, or fitness for a particular purpose. To
the fullest extent permitted by applicable law, the Developer is not liable for:
any harm to health resulting from use or misuse of information from the App without
consulting a physician or contrary to the treating healthcare professional's
instructions;
decisions by the user or third parties about diet, treatment, medicines, medical foods,
phenylalanine limits, testing schedules, or other medically significant actions;
inaccuracies, outdated information, omissions, or discrepancies in calculations, the food
database, recipes, articles, prompts, photo recognition, barcodes, voice input, or AI
assistant responses;
differences between App reference data and the actual composition of a specific product,
dish, batch, manufacturer, or laboratory result;
errors, delays, limitations, or changes in third-party services, including Google
Firebase, Google Cloud, Google Gemini, payment services, app stores, and other external
platforms;
indirect losses, data loss, lost profits, emotional distress, or other consequences where
such limitation is allowed by applicable law;
interruptions to the App, or data loss caused by failures in third-party infrastructure
(Google Firebase / Google Cloud) or other circumstances beyond the Developer's reasonable
control.
Nothing in this section limits liability where such limitation is not permitted by
applicable law (for example, consumer-protection law in your country), or excludes the
Developer's duty to act in good faith and take reasonable steps to correct known material
errors.
8. Termination
You may stop using the App and delete your account at any time by contacting
support@mschess.app;
We may suspend or terminate a user's access to the App for a material breach of these
Terms;
Upon account deletion, corresponding data is deleted as described in the
Privacy Policy.
9. Changes to These Terms
We may update these Terms from time to time. The current effective date is shown at the top
of this document. Material changes will be communicated to users within the App. Continued
use of the App after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are interpreted in accordance with applicable law, without prejudice to
mandatory consumer-protection provisions of the law of your country of habitual residence,
which may grant you additional rights not limited by these Terms.
